The petitioner is apprehending his arrest in connection with Patrakar Nagar P.S.Case no.15 of 2018 dated 10.01.2018 registered for offences punishable under Sections 304B/34 of the Indian Penal Code.

The case is of dowry death and the petitioner happens to be husband.

Submission of the learned counsel for the petitioner is that as a matter of fact the statement of the brother of the deceased itself shows that she has committed suicide and later on a petition has also been filed by the father of the deceased that due to sheer confusion the case has been filed. Heard learned A.P.P. , who has opposed the prayer for bail stating that the statement of the brother of the deceased

Patna High Court CR. MISC. No.8921 of 2019(4) dt.23-04-2019 2/2 shows that after quarrel, the deceased has committed suicide, as such there are materials against the petitioner at present. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record including the statement of the brother of the deceased and if possible to be disposed of on the same day.

With the aforesaid observation, this application is dismissed.
