Petitioners seek bail in a case registered for the offences punishable under sections 461, 379 of the Indian Penal Code.

Petitioners are not named in the F.I.R. but during course of investigation both the petitioners are alleged to have confessed their guilt and in furtherance thereof stolen D.V.D. player and three DVD were recovered from the shop of the petitioners. Similarly situated co-accused Hari Narayan Gupta from whose possession also stolen articles were recovered has already been enlarged on bail by the court below itself vide order passed in B.P. No. 830 of 2015. Petitioners are in jail since

Patna High Court Cr.Misc. No.45073 of 2015 (2) dt.29-09-2015 21.07.2015. Petitioners have got no criminal antecedent. Considering the facts aforesaid, petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Ashish Mishra, Judicial Magistrate, 1st Class, Gopalganj in connection with Bhorey P.S. Case No. 142 of 2015.
