Agarwal, learned senior Advocate for the petitioner and Mr. Arun Kumar Pandey for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sultanganj P.S. Case No. 182 of 2020 dated 06.09.2020 instituted for the offences under Sections 341, 307 of the Indian Penal Code.

The petitioner is said to have engaged the services of the victim for removing the scaffold from his newly constructed house when accidentally, electric live wire fell down on the body of the concerned labourer as a result of which he got injured.

It has been submitted on behalf of the petitioner that all possible precaution had been taken by him and the Electricity

Patna High Court CR. MISC. No.18947 of 2021(3) dt.11-03-2022 2/2 Department was also informed for disconnecting the line for the time the scaffold was removed. However by mistake, the electric line was restored while the labourer engaged by the petitioner was on duty. With the medical aid and all kinds of assistance provided by the petitioner to the victim, he has now recovered.

Considering this aspect of the matter, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 182 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
