The petitioner has preferred this application for grant of regular bail in a case registered under sections 386 and 120B of the Indian Penal Code, section 27 of the Arms Act and section 17 of C.L.A. Act.

As per the prosecution case, it is stated that the informant received a phone call asking for rangdari. Thereafter, the accused persons came on motorcycle, left behind a chit of paper with the mobile number mentioned thereon and went away firing and stating that the payment should be made. On inquiry it transpired that the mobile number belonged to this petitioner.

It is submitted by learned counsel for the petitioner that except for the vague allegation in the FIR, no material has transpired against the petitioner to connect him with the alleged

Patna High Court CR. MISC. No.18952 of 2021(3) dt.07-10-2021 2/2 crime. The petitioner has been falsely implicated in the case because of his antecedent. He is in custody since 18.5.2020 and chargesheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Barachatti P.S. Case no. 518 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, Gaya.
