JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim stated in her statement under section 164 of the Cr.P.C that she eloped with co-accused Sunil Paswan, who happens to be son of the petitioner, on her own sweet will. The victim has stated nothing against the petitioner but in spite of that the learned Additional Session Judge, Rosera rejected the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Rosera, Samastipur in connection with Hathauri P.S.Case No. 07 of 2015.
