JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was working as cashier in the concerned bank at the time of alleged occurrence and when the withdrawal of huge amount from the account of one, Sushila Mehata was detected, the officials of the bank conducted an inquiry and on the basis of CCTV footage, it came to light that one person withdrew huge amount twice and gave certain amount to the petitioner. Furthermore, it came to light that the aforesaid person got opened a fake account in the name of one, Suman Kumar and at the time of opening the account as well as withdrawal of the amount, the petitioner helped him. Subsequently, when the facebook account of the petitioner was verified, the photograph of that person was
Patna High Court Cr.Misc. No.44601 of 2015 (3) dt.22-01-2016 2/2 found in the facebook account of the petitioner. In course of investigation, witnesses supported the aforesaid fact, which is evident from perusal of paragraphs-5 & 41 of the case diary.
It is a serious case of cheating and the involvement of the petitioner in the alleged crime, prima facie, surfaced in course of inquiry and hence, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Madhubani Town P.S. Case No. 225 of 2015 pending in the court of learned Chief Judicial Magistrate, Madhubani stands rejected, at least, at this stage.
