KUMAR ORAL ORDER (The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence.) 05-10-2020 Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366(A), 34 of the Indian Penal Code.

Allegation against the FIR named accused including the petitioner is to have abducted the daughter of the informant with an intention either to marry or sell her. It is submitted on behalf of the petitioner that she is innocent and has been falsely implicated in this case. It is further submitted that petitioner has been implicated in this case being the mother of co-accused Rahul Paswan who was in love with the victim girl, with whom, victim girl eloped on her own volition and sweet will. Patna High Court CR. MISC. No.6760 of 2020(2) dt.05-10-2020 2/2 has been compromised and both the parties have filed a joint compromise petition along with leave petition before the learned A.C.J.M., 3, East Champaran at Motihari on 05.08.2019, which is annexed as Annexure 2 series. Petitioner has a clean antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bonds of Rs.20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Kesariya P.S. Case No.55 of 2019 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
