JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dinara P.S. Case No. 464 of 2018, registered for the offences punishable under Sections 341, 323, 354B, 504, 506/379 of the Indian Penal Code and Section 8 of POCSO Act. Allegation against the petitioner is of lifting the minor daughter of the informant and trying to outrage her modesty. However, police reached there and he fled away. Submission of learned counsel for the petitioner is that he has falsely been implicated due to the fact that earlier brother of the petitioner had lodged a case against the informant and others in which trial has now commenced and evidence is going on and just to pressurise the petitioner the false an concocted case has been filed.

No.7368 of 2019(3) dt.04-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Rohtas at Sasaram, in connection with Dinara P.S. Case No. 464 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
