JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-03-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Sahiyara P.S. Case No.166 of 2023 instituted under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

3. Allegation against the petitioner is that he was appointed as a teacher on the basis of forged certificate.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The certificate of the petitioner was duly verified by the vigilance which was issued by the concerned authority and the present F.I.R. was lodged without any enquiry or physical

Patna High Court CR. MISC. No.15417 of 2024(2) dt.19-03-2024 2/2 verification by the vigilance. However, the petitioner has already resigned from the post on 09.12.2023 and he has not been getting salary since last one year. The petitioner has no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sitamarhi in connection with Sahiyara P.S. Case No.166 of 2023, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
