2. The petitioner seeks bail in connection with Goriya Kothi (Goreakothi) P.S. Case No. 274 of 2023 dated 30.09.2023 registered for the offences punishable under Sections 399, 402, 414 of the I.P.C. and Sections 25(1-B)a, 26, 35 of the Arms Act and Sections 8, 21(b) and 22 of the N.D.P.S. Act.
3. As per the prosecution case, police apprehended four accused persons who were assembled in an orchard behind Pahelejpur High School to commit crime and the they disclosed their names as Robin Singh, Abhishek @ Shashi Pandi, Bittu Kumar and Md. Kalam. One person who fled away on a motorcycle whose name was allegedly disclosed as Niranjan

On search, one loaded country made pistol, two live cartridges, 20 small packets containing smack like substance (total weight 9.070 gms) and one mobile were recovered from the co-accused, Abhishek @ Shashi Pandit, one loaded country made pistol with one live cartridge and a polybag containing 18 paper packets of smack like substance (total weight 8.700 gms) were recovered from the co-accused Bittu Kumar, two live cartridges and a motorcycle were recovered from the co-accused Md. Kalam and one loaded country made pistol with one live cartridge and a polybag containing 25 paper packets of smack like susbtance (total 9.130 gms) was recovered from the co-accused, Robin Singh.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. No incriminating article has been recovered from his possession. The apprehended person disclosed the name of the petitioner. He has no concern with the alleged recovery. The petitioner has three criminal antecedents as stated in para-3 of the bail petition. The petitioner is in custody in this case since 23.08.2024. The co-accused has been granted regular bail by this Court vide order dated 26.10.2024 passed in Cr. Misc. No. 60374 of 2024.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge, Siwan in connection with Goriya Kothi (Goreakothi) P.S. Case No. 274 of 2023 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
