JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324, 341, 379 and 448 of the Indian Penal Code. It is alleged that the petitioner assaulted with Gupti to Prince Kumar Singh.
It is submitted by learned counsel for the petitioner that there is no injury report of Prince Kumar Singh on record. After investigation, the petitioner was not sent up for trial and final form was submitted but differing with the final form, cognizance was taken against the petitioner. Other similar situated accused person Gorakh Nath Singh has been granted anticipatory bail vide Cr. Misc. No. 50038 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
