JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barauli P.S. Case No. 294 of 2019 for the offence under Sections 363 and 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 07.11.2019. The petitioner is elder brother of co-accused Santosh Kumar with whom the victim accompanied and joined wedlock as evident from her statement recorded under Section 164 of the Cr.P.C.

Considering the statement of the victim recorded under Section 164 of the Cr.P.C., the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/-
