Petitioner Anshu Kumari seeks bail in Samastipur Muffasil P.S. Case No.466 of 2013 registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code. The informant named Rahul Kumar and alleged that Rahul Kumar along with friends kidnapped his daughter. Learned counsel for the petitioner submits that the petitioner is not named in the first information report. The victim girl was not recovered from the possession of the petitioner. The girl had come to the house of petitioner from the railway platform. Later on, Rahul Kumar took the girl and he was arrested with the victim girl. Rahbare Alam alias Ajnabi has been granted regular bail vide Cr.Misc. No.16019 of 2014 and similarly Kundan Sharma has also been granted bail vide Cr. Misc. 10983
Patna High Court Cr.Misc. No.42455 of 2014 (3) dt.16-02-2015 2/2 of 2014.
Considering the fact that there is no allegation of kidnapping against the petitioner who is a lady, she is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Samastipur Muffasil P.S. Case No.466 of 2013.
