JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This application, for grant of anticipatory bail, arises out of Baikunthpur P.S. Case No. 246 of 2018, disclosing offences under Sections 341, 323, 354(B) of the Indian Penal Code.

Allegation against the petitioner is of trying to outrage the modesty of the informant.

Submission of learned counsel for the petitioner is that the altercation took place between the parties with respect to grazing of she goat of the petitioner and in the field of informant and no such occurrence as alleged by the informant has ever taken place and further there is delay of five days in lodging the F.I.R and for that no plausible explanation has been offered.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 246 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
