The petitioner has prayed for bail in a case registered for the offence punishable under section 377 of the IPC and Section 3(i)(R)(s) of the SC/ST Act.

As per allegation in the FIR, while the informant had gone to duty at Gramin Bank in the meantime, petitioner Deepu Singh came to her house and taken away her son and committed un-natural intercourse with him.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. . Petitioner is a deaf and dumb man. As per medical report, doctor opined that it is not a case of Sodomy or Un-natural

Patna High Court CR. MISC. No.8292 of 2023(2) dt.25-02-2023 2/2 intercourse. Petitioner is languishing in judicial custody since 14.12.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1 Kaimur at Bhabua in connection with Bhagawanpur P.S. Case No. 279 of 2022.
