04-03-2015 Heard learned counsel for the petitioner and Sri Harendra Prasad, learned Addl. Public Prosecutor. The petitioner, who is in custody since 10-07-2013 in Dumariyaghat P.S. Case No. 86 of 2013 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that other two accused persons, namely; Pappu Kumar and Rakesh Kumar were already granted bail by this Court on 25-04-2014, vide Cr. Misc. No. 10589 of 2014.
Learned Addl. Public Prosecutor opposes the prayer of bail. He submits that one loaded country-made pistol was recovered from the possession of the petitioner.

No.49274 of 2014 (3) dt.04-03-2015 2/2 Keeping in view the fact that some other accused persons have already been granted bail and the petitioner is in custody since 10-07-2013, let the petitioner namely Naveen Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Motihari, in connection with Dumariyaghat P.S.
