The present case was lodged against one Dasrath Yadav son Sri Ramdev Yadav resident of village Rajauli P.S. Tiliya District Hazaribagh on the accusation that the aforesaid Dasrath Yadav @ Sanjay Yadav misappropriated iron rods and other articles. The contention on behalf of the petitioner is that petitioner's name is Santosh Yadav @ Dashrath Yadav son of Ramdhani Yadav @ Ramdeo Yadav resident of Village Sohada, Police Station Rajauli, District Nawada and, as a matter of fact, he has falsely been implicated in this case. It is also pointed out on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and recovery has been made from the possession of one Raju Yadav. It is also submitted that paragraphs referred by the
Patna High Court Cr.Misc. No.43433 of 2014 (5) dt.07-08-2015 learned Sessions Judge in the impugned order are not relevant in respect of the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Barun P.S. Case no. 275/2010.
