JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioners seek bail in connection with Koilwar P.S. Case No. 152 of 2019, registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code. Petitioners are named in the FIR and there is allegation of assault to the deceased.

Submission of learned counsel for the petitioners is that specific allegation of assault is against one Baijnath Yadav to the deceased and considering the same co-accused persons have been granted bail by the then co-ordinate Bench of this Court by order dated 2.8.2019 passed in Cr.Misc.No. 46687 of 2019 and by order dated 30.8.2019 passed in Cr.Misc.No. 47129 of 2019 and petitioners are in custody since 24.12.2019.

In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 152 of 2019 on the condition that they have to co-operate in the investigation, otherwise their bail bonds shall be cancelled.
