2. The petitioner seeks bail in connection with Barh P.S. Case No. 247 of 2017 instituted for the offences under Sections 304(B) and 34 of the IPC.

3. Brother of the deceased had lodged the F.I.R. on 26.08.2017 with the allegation that the petitioner killed his sister by burning her. The post-mortem report support the allegation.

4. Learned counsel for the petitioner states that marriage was solemnized some 10 years back and the petitioner has three children. The petitioner is in custody since 16.09.2025 and has got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. That it has come during investigation that deceased probably was in illicit relationship with someone else and the

The court will not make any comment on the merits of the case at present. But an alternative story has come up during investigation. The petitioner has three children who will be rendered guardian less. Considering the clean antecedent of the petitioner and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Barh, Patna/concerned Court in connection with Barh P.S. Case No. 247 of 2017.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
