JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Mufassil P.S. Case No. 353 of 2019 for the offence under Section 30(a) read with Section 13 of the Bihar Prohibition & Excise Amendment Act, 2016.

In the instant case total 5.25 litres of foreign liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that nothing was recovered from the possession of the petitioner, but the liquor was seized from the joint family house occupied by several family members.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail

Patna High Court CR. MISC. No.7193 of 2020(2) dt.29-02-2020 2/2 on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Katihar in connection with Mufassil P.S.
