The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the house of the petitioner, 6.5 litres of illicit country made liquor were recovered.

It is submitted by learned counsel for the petitioner that the petitioner was not present in the house when the seizure was made and the said recovery has been made from the joint family house of the petitioner.

It is submitted by learned APP that recovery has been made from the house of the petitioner and named in the FIR. Considering the quantity of recovery, this Court is not

Patna High Court Cr.Misc. No.7989 of 2019(2) dt.13-02-2019 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

Let the learned Court below consider the prayer for regular bail of the petitioner, without being prejudiced by the order of this Court, if he surrenders within a period of six weeks, in connection with Sirdalla P.S.
