Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
Since the allegation is under Bihar Prohibition and Excise Act and the petitioner has got an identical criminal antecedent, in my view, this is not a fit case for grant of anticipatory bail to the petitioner in connection with Muffasil P.S.Case No.135 of 2020 pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Nawada. Hence, prayer is refused.
