Patna High Court C.Misc. No.671 of 2016 (2) dt.21-09-2016
IN THE HIGH COURT OF JUDICATURE AT PATNA
CIVIL MISCELLANEOUS JURISDICTION No.671 of 2016 ====================================================== Roshan Kumar .... .... Appellant/s
Versus
Priti Devi .... .... Respondent/s ====================================================== Appearance :
For the Appellant/s : Mr. Dronacharya For the Respondent/s : Mr.
====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 21-09-2016 Heard the learned counsel, Mr. Dronacharya for the petitioner.
Perused the impugned order dated 02.06.2016. The learned Court below considering the fact that in 125 Cr.P.C. proceeding, the husband-petitioner has been directed to pay Rs.1,500, has only directed to pay further Rs.500 in Matrimonial Suit No.13 of 2014 by order dated 02.06.2016 passed by Principal Judge, Family Court, Lakhisarai.
In such view of the matter, it cannot be said that the order passed by the Court below is without jurisdiction or that it has been passed in the manner not permitted by law. Therefore, in my opinion, there is no jurisdictional error so as to call for exercise of jurisdiction under Article 227 of the Constitution of India.
Thus, this Civil Miscellaneous application is dismissed. Saurabh/- (Mungeshwar Sahoo, J) U T
