JUSTICE SUDHIR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending her arrest in connection with Chhatapur P.S. Case No.75 of 2015 for the offences instituted under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The prosecution story, in brief, is that the informant is panchayat Secretary of Chhatapur Gram Panchayat. The informant has stated that as per instruction of the District Magistrate, Supaul contained in memo No.71/1 con. Dated 13.3.2015, he lodged the F.I.R. against the candidates who have tried to cheat by filing forged and fabricated TET certificate in order to got their appointment as teacher and during course of

Patna High Court Cr.Misc. No.45950 of 2015 (3) dt.01-02-2016 2/2 enquiry their certificates have been found forged and fabricated. It is submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. It has been submitted on behalf of the petitioner that on account of the fact that he has sought for an appointment on the basis of fake certificate for the post of teacher. It is further submitted that the petitioner had never tendered his joining. Hence, no loss has been caused to the State Government. Other co-accused has been granted bail vide Cr. Misc. No.32346 of 2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Supaul, in connection with Chhatapur P.S. Case No.75 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
