JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-11-2022 This petitioner is the sole assailant whose prayer for bail was earlier rejected by this Court vide order dated 17.01.2020 in Cr. Misc. No. 83559 of 2019.

The petitioner has renewed his prayer for bail. This Court called for a report from the learned trial court as to the present stage of the trial and the time likely to be taken in conclusion thereof. The report as contained in letter no. 475 dated 06.09.2022 (Flag 'A') has been received from the learned trial court. It shows that out of ten prosecution witnesses, seven witnesses have already been examined and only three charge-sheet witnesses remain to be examined. Learned trial court has given to understand that the Court is striving for speedy disposal of case and if both the parties co-operate and the evidence is adduced regularly then the case is expected to be disposed of within two months.

No.8589 of 2022(3) dt.09-11-2022 2/2 Considering the nature of allegations against the petitioner which this Court had noted in its order dated 17.01.2020, this Court is not inclined to grant bail to the petitioner. Since, the trial itself is likely to be concluded within a short period, the petitioner as well as the prosecution are directed to co-operate with the trial court. The Superintendent of Police, Vaishali at Hajipur shall ensure that the official witnesses such as I.O. of the case remain present on the date fixed in the matter.

All endeavours be made to conclude the trial as early as possible.
