JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Siwan Mufasil P.S. Case No. 375 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that in the instant case total 3.600 litres of foreign liquor was seized. He further submits that nothing was seized from the conscious possession of the petitioner.

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand)

Patna High Court CR. MISC. No.6979 of 2020(2) dt.28-02-2020 2/2 with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Siwan in connection with Siwan Mufasil P.S. Case No. 375 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
