2. The writ petition has been filed seeking the following reliefs:

"That this is an application for issuance of an appropriate writ, order or direction commanding the respondents to pay the retrial benefits viz. Gratuity, leave encashment, amount of G.I.C, arrears of 26 months to the petitioner and further be pleased to direct the respondents to pay the admissible arrears of dearness allowance w.e.f. July 2001 to October 2008 for which the petitioner is legally entitled for in terms of official order dated 23.09.2009.

3. Though, there was issue raised with regard to maintainability of the writ petition in terms of the Special Bench

Patna High Court CWJC No.11821 of 2016 (2) dt.30-11-2017 2/2 judgment of this Court in the case of The Organizer, Dehri C.D. & C.M. Union Ltd. vs. State of Bihar reported as 2014(1) PLJR 695, but learned counsel for the respondents submitted that in view of various pronouncements of the Court and the matter having been taken to the Hon'ble Supreme Court, a modality has been fixed with regard to disbursement of retiral benefits to the employees, which is being followed and shall be followed by the respondents.

4. In view of the stand taken in the counter affidavit itself, there is no necessity to pass any order.

5. Accordingly, the writ petition stands disposed off with the observation that in terms of the scheme/modality as formulated by the Court, which has attained finality, the petitioner shall also be paid his retrial benefits. (Ahsanuddin Amanullah, J.) P. Kumar U
