The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.
The petitioner was apprehended after the alleged looting and hence it is stated that part of the looted money was recovered from the conscious possession of the petitioner whereas the mobile and fire arms are said to have been recovered from the possession of other accused. Admittedly, co-accused Rakesh Kumar and Shailendra Kumar have already been granted privilege of bail and so far petitioner is concerned, earlier his prayer for bail was rejected by a coordinate Bench of this Court vide order dated 14.2.2014 passed in Cr. Misc. no. 51740 of 2013 taking note of the fact that part of the looted money had been recovered from the conscious possession of the petitioner but petitioner is in jail custody since 19.7.2013 and up-till-now no charge could be framed against him. Therefore, it is obvious that there is no likelihood of conclusion of his trial, though trial court has sought six months time for conclusion of the trial of the petitioner. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner behind the bar, let
