This application for grant of regular bail arises out of Hajipur Town P.S. Case No. 353 of 2015, disclosing offences under Sections 399 and 402 of the Indian Penal Code and 25(1b)A/26/35 of the Arms Act. It is submitted on behalf of the petitioner that as per the prosecution case, from the petitioner's possession, two live cartridges were recovered. As regards his implication in another case i.e. Hajipur Town P.S. Case No. 1126 of 2014, it has been submitted that in the said case, the petitioner is on bail. She further contends that similarly situated co-accused person namely, Md. Nasim has been granted regular bail by this Court by an order

Patna High Court Cr.Misc. No.46619 of 2015 (2) dt.15-10-2015 2/2 dated 20.08.2015 passed in Criminal Miscellaneous No. 34246 of 2015.

In view of the submission as above, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 353 of 2015. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
