The petitioner is in custody in connection with Sultanganj P.S. Case No. 317 of 2018, registered for the offence punishable under Sections 279, 379, 411, 428, 429 of the Indian Penal Code and Section 3/ 4 of Bihar Animal Protection & Reproduction Act and Section 11 (i)/ DEF, Animal Protection Redressal, Act, 1960.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He further submits that during the raid conducted by the police four pick up vans were intercepted which were carrying 33 animals ( 18 cows and 15 calves) out of which two cows were found dead. Learned counsel for the petitioner submits that petitioner is neither the owner of the vehicle nor driver of the vehicle, he was sitting along with

Patna High Court Cr.Misc. No.8110 of 2019(2) dt.13-02-2019 2/2 the driver in the vehicle. He has been made accused in the instant case. Learned counsel for the petitioner further submits that co-accused Naresh Ravidas has been granted bail vide order dated 02.01.2019 in CR. Misc. No. 77622.

Considering the fact that petitioner has no criminal antecedent and other co-accused has been granted bail, let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M.- II, Patna City in connection with Sultanganj P.S. Case No. 317 of 2018.
