JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 406, 323,504 and 120B of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the First Information Report has been instituted on reference made under Section 156(3) of the Cr. P.C. The complaint petition was filed by Yugal Kishore Ram, who claimed himself to be a social worker. The petitioners are P.D. S. dealers and they are members

Patna High Court Cr.Misc. No.42322 of 2014 (2) dt.16-04-2015 of Prakhand Samiti of Gram Panchayat Kalyanpur. From the complaint petition, it appears that the allegation against them is of illegal distribution of Kerosene oil to the people who are not entitled for it. I am persuaded with the submission made on behalf of the petitioners that there is no specific allegation with reference to any specific occurrence in the First Information Report. In view of the submissions as above,, let petitioners above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in Durgawati P.S. case No. 120 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
