JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 04.03.2015 passed in Cr. Misc. No. 4811 of 2015 on the ground that there is no progress in the trial and up till now no prosecution witness has been examined which is evident from letter no. 138 of 2016 of the 1st Additional Sessions Judge- Cum- Special Judge, Araria. The petitioner is suffering in custody since 08.05.2014.
The learned A.P.P. opposes prayer for bail.
In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner is rejected in connection with Forbesganj
Patna High Court Cr.Misc. No.9505 of 2016 (3) dt.18-05-2016 2/2 P.S. Case No. 199 of 2014 / G.R. No. 1166 of 2014 pending in the court of the 1st Additional Sessions Judge, Araria. However, the learned trial Judge is directed to take all positive steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order after keeping the same on the day to day basis. The concerned Superintendent of Police is also directed to direct the Officer Incharge concerned to produce the witnesses in the court so that the trial be concluded as early as possible.
Let a copy of this order be also sent to the Superintendent of Police, Araria for immediate compliance. (Jitendra Mohan Sharma, J) Abhay/- U T
