JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 447, 341, 323, 427, 324 and 326/34 of the I.P.C The allegation against the petitioner is that he assaulted the informant with Dabia twice causing injury to his left hand.

Submission is of false implication and that no injury has been caused on the vital part of the informant, the petitioner is suffering in custody since 17.08.2015 and as such now he deserves sympathetic consideration, to which the learned A.P.P. does not dispute.

No.45872 of 2015 (4) dt.29-02-2016 2/2 In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri T.K. Jha, J.M. 1st Class, Khagaria in Allauli P.S. Case No. 271 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
