====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 22-02-2019 Heard the learned counsel for the petitioner and the State.

2. The petitioner, who had joined services as Clerk in the Provident Fund Department but superannuated as an Assistant in the Road Construction Department, has approached this Court for a direction to the authorities to grant him the benefits of MACP with effect from 01.01.2009 in the grade pay of Rs. 4600/- and for other

Patna High Court CWJC No.3329 of 2019 dt.22-02-2019 2/2 benefits in the nature of increment and Dearness Allowances which are admissible to him.

3. Without referring to the claims of the petitioner, this Court, on coming to know that the petitioner has represented before the Secretary, Road Construction Department for redressal of his grievances, deems it appropriate to direct the petitioner to file a fresh representation before the Secretary, Road Construction Department detailing his grievances/claims and the reasons for putting up such claim within a period of four weeks from today. On receipt of such representation, the concerned respondent viz. the Secretary, Road Construction Department shall after verifying the facts and if possible giving a hearing to the petitioner shall dispose of such representation within a further period of six weeks thereafter.

4. With the aforesaid direction/observation, the writ petition is disposed of.
