The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, the six accused persons including the petitioner are stated to have assaulted the brother of the informant with various arms. It is further stated that accused Sajan Kumar assaulted the informant's brother with a knife on his neck as a result of which he fell down injured and died. On being taken to the hospital he was declared dead. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations against the petitioner are general and omnibus in

Patna High Court CR. MISC. No.18959 of 2021(3) dt.21-10-2021 2/2 nature. The petitioner is in custody since 19.10.2020 and has no criminal antecedent. It is lastly submitted that co-accused Ravi Sahni has been enlarged on bail vide order dated 30.6.2021 passed in Cr. Misc. No. 10259 of 2021.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner together with the contents of the postmortem report and the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Darbhanga Town P.S. Case no. 222 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga.
