JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner and one Munna Kumar were caught with the stolen motorcycle and one person managed to escape from there.

The contention on behalf of the petitioner is that the petitioner does not have any criminal antecedent and, as a matter of fact, the aforesaid motorcycle has been recovered from the joint possession of two persons for which the petitioner is in jail since long.

Considering the aforesaid facts and circumstances as well as submission of the parties, the above named petitioner is

Patna High Court Cr.Misc. No.45139 of 2015 (2) dt.29-09-2015 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Turkauliya P.S. Case No. 456 of 2015 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari.
