JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 02-05-2025 The present petition in public interest has been filed for seeking a direction to the respondents restraining them from shifting the construction of Panchayat Sarkar Bhawan from one site to another, which

Patna High Court CWJC No.2004 of 2025(3) dt.02-05-2025 2/3 site had earlier been selected in the year 2021 in the headquarter village of the Panchayat.

2. It appears from the records that the Headquarter village was Modanganj where the land which was selected actually is located in the middle of the village where the access of larger vehicles would not have been possible.

3. The other ground was that the land so selected was shown as 'dagar' i.e. road and, therefore, the selection was not proper. Later, another site was selected for construction of the Panchayat Sarkar Bhawan at Govindpur which is a revenue village of Modanganj. In fact, the area is referred to as Modanganj-Govindpur. The site of the construction is on a plot which falls in Mauza Govindpur which is part of the revenue villages of Modanganj Panchayat.

4. This Court has also been informed that the construction of the Panchayat Sarkar Bhawan is at the advanced stage of construction.

5. Considering these two aspects of the matter, we refrain ourselves from going any further in this matter and dismiss this petition.
