Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Chandan (Anandpur) P.S. Case No. 80 of 2019 for the offence punishable under Sections 384 and 387 of the Indian Penal Code.

Allegation against the petitioner is of demand of extortion from the informant.

It has been submitted by learned counsel for the petitioner that there is some money dispute between the parties and due to which, this false case has been lodged against the petitioner.

Patna High Court CR. MISC. No.6993 of 2020(5) dt.22-04-2022 2/2 Considering the aforesaid facts, this bail application is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Chandan (Anandpur) P.S. Case No. 80 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

However, at the time of furnishing the bail bonds, the petitioner will produce a demand draft of Rs.1,00,000/- prepared in the name of the informant and the Court below, in turn, will hand over the same to the informant within time so that the draft may be encashed. If the petitioner produces the said demand draft, the Court below shall accept his bail bonds. If the petitioner does not produce the said demand draft, in such a situation, the bail bonds of the petitioner shall not be accepted by the Court below and he shall be taken into custody.
