ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the complainant. The petitioners apprehended their arrest in connection with Falka (Pothia) No. 35 of 2016 registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that when the informant was returning after attending feast from the house of one Gonath Mandal, all the petitioners badly assaulted him with farsa and iron rod. The injuries found on two of the injured persons are said to be of hard and blunt object, where as the nature of injury of one of the person has been kept reserved. Learned counsel for the

Considering the aforementioned facts and circumstances of the case and there is also a delay in lodging the F.I.R. which stands unexplained, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistarte - V, Katihar, in connection with Falka (Pothia) P.S. Case No. 35 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
