Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A) and 304(B)/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Wife of the petitioner died within seven years of her marriage in the matrimonial house in unnatural circumstances. There is allegation of demand of more dowry and torture for nonfulfillment of the same. The witnesses have supported the aforesaid allegation before the police.

Submission is that there was Panchayati of the dispute between the parties as the victim was herself in the habit of making attempt to commit suicide and she had, in the past, also attempted to commit suicide. Petitioner is in custody since

Patna High Court CR. MISC. No.12713 of 2021(3) dt.01-09-2021 2/2 25.06.2020.

Considering the nature of allegation and available material on the record, I am not inclined to enlarge the petitioner on bail in connection with Marhowrah P.S. Case No. 43 of 2020 pending in the Court of learned Judicial Magistrate, 1st Class, Saran at Chapra.

Hence, prayer is refused.

Learned Trial Court is directed to expedite the trial of the case.
