This is a petition for grant of regular bail for offence under Sections 498A and 323 of the Penal Code. The learned counsel for the petitioner submits that the petitioner is either ready to keep his wife with full dignity or, if for any reason the wife is not ready to live with him, he is ready to pay maintenance of Rs.1500/- per month.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on provisional bail for three months on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 401 of 2013 to the satisfaction of Sri S.D. Bharti, Judicial Magistrate, 1st Class, Saran at Chapra, subject to the conditions that after one month of his release the petitioner shall keep his wife with full dignity or if for any reason the wife is not ready to live with him, the petitioner shall pay maintenance worth Rs.1500/- per month, till a higher maintenance decided by a

No.43911 of 2014 (4) dt.14-01-2015 2/2 competent Court and after three months the Court below, on being satisfied that the petitioner is fulfilling the conditions, shall confirm the bail bond and the petitioner shall appear in person in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner by the lower Court itself.
