JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This an application for grant of regular bail on behalf of the petitioner who is an accused in Koran Sarai PS Case No. 59 of 2015 for offences under Sections 411, 413, 414 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that his name surfaced in course of investigation, on the basis of confessional statement of one Manish Kumar, a co-accused, leading to recovery of one motorcycle from the premises belonging to the petitioner. Learned counsel has referred to an order of this Court dated 30.9.2015 passed in Cr. Misc. No. 45927 of 2015 in order to submit that similarly circumstanced co-accused Shiv Kumar Kushwaha @

Patna High Court Cr.Misc. No.45735 of 2015 (2) dt.05-10-2015 2/2 Shiv Kumar Singh has been granted regular bail. The petitioner is said to be in custody since 31.7.2015 and it has been stated that he does not have any criminal antecedent.

In view of the submission as above, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Koran Sarai PS Case No. 59 of 2015. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
