2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30(a) and 41 of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 40 liters of country made liquor was recovered from a bike.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Petitioner has got no concern either with the alleged liquor or with the bike in question. Police was pressurized him to become a search witness to which he denied that is why he has been dragged in this case. A statement has been made in para-3 of this petition

Patna High Court CR. MISC. No.8558 of 2025(2) dt.11-02-2025 2/2 that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 20.01.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sirdalla P.S. Case No. 22 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-1, Nawada.
