1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Baisi P.S. Case no.96 of 2022 registered under sections 8/20 (b)(ii)(c) of the N. D. P. S. Act.

3. As per the prosecution case, 17.5 kgs of ganja was recovered from beneath the seat of the bus where the petitioner was sitting and he was taken into custody.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The petitioner was merely a passenger and the alleged bag from which the ganja was allegedly recovered does not belong to the petitioner. The petitioner is in custody since 12.3.2022 and has

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR, the petitioner having remained in custody for more than 1 year since 12.3.2022, not having any criminal antecedent and chargesshet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Baisi P. S. Case no.96 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act, Purnea.
