Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Prosecution case is that 600 ml illicit country made liquor was recovered from the Bolero car.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating articles has been recovered from the conscious possession or house of the petitioner and the petitioner is not the owner of the vehicle. Petitioner claims clean antecedent.

Considering the facts of the case, in the event of

Patna High Court CR. MISC. No.8948 of 2023(2) dt.24-04-2023 2/2 arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Aurangabad in connection with Muffasil Police Station Case No. 43 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
