JUSTICE GOPAL PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 27-03-2015 The appellant Vijay Vijay Singh @ Langwa @ Vijay Yadav figured as accused No.4 in Sessions Trial No.1011 of 2006/251 of 2006, on the file of the Additional Sessions Judge, F.T.C. III, Patna. He was convicted for the offence punishable under Section302/34 of I.P.C. and was sentenced to undergo imprisonment for life. On his behalf, Criminal Appeal No.642 of 2009 was filed and the same was admitted. A Division Bench of this Court has also granted bail on 3.4.2012. However, on behalf the same person the present appeal i.e. Criminal Appeal No.814 of 2014 is filed. The reason for this is said to be that Criminal

Patna High Court CR. APP (DB) No.814 of 2014 (4) dt.27-03-2015 2/2 Appeal No.642 of 2009 was filed from jail.

At this stage, learned counsel for the appellant seeks permission of the Court to withdraw Criminal Appeal No.814 of 2010. Permission is accorded. Appeal is dismissed as withdrawn.

We direct the registry to list Criminal Appeal No. 642 of 2009 for hearing forthwith before the concerned Bench. The registry shall also verify as to whether any other appeals have been filed by the other accused in the same case.
