JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Siwan Mahila P.S. Case No. 82 of 2019 for offences under Sections 498A, 406, 413, 308 and 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Petitioners are father-in-law, mother-in-law, Bhainsur and Gotini of opposite party no. 2, respectively. The allegation against the petitioners is that they have tortured the opposite party no. 2 for non-fulfillment of dowry demand.

Learned counsel for the petitioners would submit that the parties have settled their dispute and normalcy has been restored in the conjugal life of opposite party no. 2 and the son of Petitioner Nos. 1 and 2.

Considering the aforesaid this Court is inclined to grant bail to the petitioners. Let petitioners, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Siwan in connection with Siwan Mahila P.S. Case No.82 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
