The petitioner seeks bail in Simultalla P.S. Case No. 37 of 2017, instituted for the offence under Section(s) 392 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. The name of petitioner has come during investigation on the ground that one of the SIM alleged to be looted by unknown accused persons was used by wife of the petitioner.

Counsel for the petitioner submits that aforesaid Mobile was purchased by his wife second hand. She has no knowledge about the aforesaid SIM having been stolen one.

Patna High Court Cr.Misc. No.7531 of 2019(2) dt.08-02-2019 2/2 Petitioner is said to be in custody since 9.3.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Simultalla P.S. Case No. 37 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
