1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 406, 467, 468 and 471 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case with an allegation that he fraudulently sold the land of the informant posing himself as informant. It is further submitted that petitioner and the informant are own brother and they are having dispute relating to property. It is next submitted that even presuming what has been alleged is true without admitting then the dispute is purely civil in nature.

The said submission of the learned counsel appearing on behalf of the petitioner stands rebutted by the learned A.P.P. for the State who submits that it is a case where it has been alleged that petitioner posing himself as informant sold the land as such it is a case of impersonation. It is submitted that by order dated 07.03.2024, the petitioner was directed to file supplementary affidavit bringing on record the copy of the sale deed but then the same till date has not been filed nor the sale deed has been brought on record which amply demonstrates that the petitioner is trying to conceal a material fact as the sale deed carries photograph of the person who executes the sale deed.

5. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to entertain the anticipatory bail application of the petitioner in connection with Kahalgaon P.S. Case No. 572 of 2023 pending in the Court of learned Chief Judicial Magistrate, Bhagalpur/successor Court.

6. Accordingly, the prayer for anticipatory bail is rejected.
