JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 This is an application for grant of regular bail in favour of the petitioner, who is an accused in connection with Biraul P.S.Case No. 208 of 2014 registered for the alleged offences punishable under Sections 328 and 302 of the Indian Penal Code. The petitioner is the husband of the deceased. The First Information Report came to be instituted by the mother-in-law of the deceased with an allegation that the petitioner might have been administered poison resulting into her death. Learned counsel for the petitioner submits that no offence under Section 302 of the Indian Penal Code is made out against the petitioner on the basis of the allegation as mentioned in the First Information Report inasmuch as admittedly the deceased was taken by the petitioner to hospital where she died in course of

Be that as it may in view of the nature of accusation, this application is allowed.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Biraul at Benipur in the district of Darbhanga in Biraul P.S.Case No. 208 of 2014. This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
